Introduction
This License Agreement ("Agreement") is entered into between Bluesky Copilot, represented by Henrique Sousa, and you, the user ("Licensee"). By accessing or using Bluesky Copilot's services available at https://bskycopilot.com/ (the "Service"), Licensee agrees to be bound by the terms and conditions of this Agreement.
License Grant
Bluesky Copilot grants Licensee a non-exclusive, non-transferable, limited license to access and use the Service in accordance with the terms of this Agreement.
Subscription Terms
a. Subscription Plans: Bluesky Copilot offers various subscription plans (e.g., Personal, Team) which provide access to different features.
b. Fees and Payment: Licensee agrees to pay the subscription fees associated with their chosen plan. All fees are non-refundable except as provided in the Refund Policy.
c. Automatic Renewal: Subscriptions automatically renew unless canceled by Licensee before the renewal date.
Restrictions
Licensee shall not:
- Reproduce, modify, adapt, translate, or create derivative works based on the Service.
- Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Service.
- Resell, sublicense, lease, rent, or distribute the Service to any third party.
- Use the Service in any manner that violates any applicable law or regulation or encourages conduct that could constitute a criminal offense.
Ownership and Intellectual Property
Bluesky Copilot retains all rights, title, and interest in and to the Service, including all intellectual property rights. This Agreement does not grant Licensee any rights to use any of Bluesky Copilot's trademarks or service marks.
Termination
a. Termination by Licensee: Licensee may terminate this Agreement by canceling their subscription through their account settings.
b. Termination by Bluesky Copilot: Bluesky Copilot may terminate this Agreement and Licensee's access to the Service immediately, without prior notice, for conduct that violates this Agreement or is harmful to other users of the Service, Bluesky Copilot, or third parties.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUESKY COPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
- ANY CONTENT OBTAINED FROM THE SERVICE;
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Azores, Portugal, without regard to its conflict of laws principles. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Azores, Portugal.
Entire Agreement
This Agreement constitutes the entire agreement between Licensee and Bluesky Copilot regarding the use of the Service and supersedes all prior agreements, understandings, or representations, whether written or oral.
Changes to the Agreement
Bluesky Copilot reserves the right to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
